  • The following information sets out the terms and conditions that constitute our Shipping Policy. 

    1/ Processing your order

    An email confirmation is sent to your email address after placing your order. Please keep this email as proof of your purchase. 

    2/ Shipping processing time

    Processing time refers to the time it takes for us to prepare your order for shipping. After your payment is authorized and verified, all orders are processed within 3 to 5 business days. We will contact you for some reason if there are any delays. 

    3/ Shipment locations

    Domestic only. Belinda Dorey Art does not ship internationally currently. We ship domestic only, anywhere in Australia. 

    4/ Shipment rates and delivery estimates

    We endeavor to get your order to you as soon as possible. Delivery times are to be used as a guide only and are subject to the acceptance and approval of your order. Estimated arrival times are not guaranteed. Weather delays and other unforeseen circumstances may impact delivery time. 

    Unless there are exceptional circumstances, we make every effort to fulfill your order. 

    5/ Standard shipping 

    The order will arrive within 7 -14 Business Days from date of shipping. Standard shipping and insurance costs to the value of the item are included in the purchase price. 

    • Please note: Business Day means Monday to Friday, except holidays. 

    • Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, and the items ordered. 

    • We will not be responsible for wrong shipping address if you provide incorrect information. 

    • In store pick up is available based on product availability. 

    6/ Tracking options

    Once your order is confirmed and shipped, you will receive a link to track your package. 

    All orders delivered within Australia automatically have tracking. 

    7/ Damages

    If there is any damage to the packaging on delivery, contact us immediately at belindadoreyart@gmail.com. Any damage in transit is the responsibility of the shipping company and we are unable to take responsibility for loss or damage to goods in transit. However, all goods are covered by transit insurance equivalent to the purchase price less postage costs.  

    Any damaged product must be returned in the condition in which it was received within 30 days of contact, together with any packaging and other items which you received with the damaged product. We will arrange to either repair or refund the damaged product, provided you have contacted us within 7 days of the date of receiving the product and returned it within the 30-day period.  

    8/ Missing or Lost Package

    There are several reasons why a package gets lost or becomes a delivery exception. We’ve found that, often, the package is either in the building or with a neighbour. Belinda Dorey Art politely requests that the customer look in common courier hiding spots. Please take a look around and let us know if you find it. If you haven’t located your order please contact us at  belindadoreyart@gmail.com to report missing or lost packages.

  • The following information sets out the terms and conditions that constitute our Returns and Refunds Policy. 

    General

    • I offer refunds and replacements in accordance with the Australian Consumer Law and on the terms set out in this Returns and Refunds Policy. (Policy) 

    • Any benefits set out in this Policy may apply in addition to consumer rights under the Australian Consumer Law. 

    • Before making a purchase, please read this Policy so that you can understand your rights and what you can expect of us if you are not satisfied with your order 

    Australian Consumer Law 

    Under the Australian Consumer Law our goods come with guarantees that cannot be excluded under the law. I offer refunds, repairs, and exchanges in accordance with the Australian Consumer Law. 

    If a product or service which you purchased from us has a major failure (as defined in the Australian Consumer Law) you may be entitled to choose a refund or replacement. 

    If a product or service which you purchased from us has a failure which does not amount to a major failure (as defined in the Australian Consumer Law) then you may still be entitled to have the goods repaired or replaced. 

    Cancellation and Change of Mind

    If you receive the products you have purchased, as stated, but that you simply change your mind, I may at my discretion offer you a refund or exchange on a same priced item, provided that 

    • You notify me within 7 days of receipt 

    • The product is undamaged 

    The 30% deposit on Commissions is non-refundable 

    Packaging and shipping costs are excluded from refunds. 

    Products Damaged During Delivery

    If the product you ordered has been damaged during delivery 

    • Please refer to the Shipping Policy for further information or email me within 7 days of receipt at belindadoreyart@gmail.com. 

    Exceptions

    Notwithstanding the other provisions of this Policy, I may refuse to provide a repair or refund for a product or service if 

    • You misused the said product in a way which caused the problem 

    • You knew or were made aware of the problem(s) with the product or service before you purchased it. 

    • You asked for alterations to a product against our advice or you were unclear about what you wanted 

    • Any other exceptions that apply under the Australian Consumer Law 

    Shipping Costs for Returns

    • If a product you have purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, I shall bear any cost of shipping the said product (the Returned Product) back to me, as well as any cost of shipping any replacement product to you. 

    • If the Returned Product can easily be shipped or returned, then you are responsible for organising for the Returned product to be returned to us. If the Returned Product is eligible for a repair or refund under the terms of this Policy (including under the Australian Consumer Law) then we will reimburse you for the reasonable postage, shipping, or transportation costs for the Returned Product. 

    How to Return Products

    • Contact me within 7 days of receipt of goods, with photos of the damage and details of the problem, your name, invoice number, product name/code and reasons for requiring repair, exchange or refund. 

    • You must provide proof of purchase 

    • Once I receive your item, I will inspect it and notify you that I have received the Returned Product. I will notify you within 3-7 days on the status of your refund after inspecting the item. 

    •  All refunds will be paid to the same account or credit card used to make the original purchase 

    Response Times

    You can contact me by email belindadoreyart@gmail.com or the contact page at www.belindadoreyart.com.au. to discuss a return, exchange, or refund. I aim to process any requests for repairs, exchanges or refunds within 3 -7 days of receipt. If the request or complaint will take longer to resolve, I will provide you with a date by which we expect to respond.

  • Consent: By accessing and/or using our Site, you agree to these terms of use and our Privacy Policy available on our site.(Terms). Please read these Terms carefully and immediately cease using our Site if you do not agree to them.  

    Variations: We may, at any time and at our discretion, vary these Terms by publishing the varied terms on our Site. We recommend you check our Site regularly to ensure you are aware of our current terms. Materials and information on this Site (Content) are subject to change without notice. We do not undertake to keep our Site up-to-date, and we are not liable if any Content is inaccurate or out-of-date. 

    Licence to use our Site: We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable licence to use our Site in accordance with these Terms.  All other uses are prohibited without our prior written consent. 

    Prohibited conduct: You must not do or attempt to do anything: that is unlawful; prohibited by any laws applicable to our Site; which we would consider inappropriate; or which might bring us or our Site into disrepute, including (without limitation): 

    • anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual's consent) or any other legal rights. 

    • using our Site to defame, harass, threaten, menace, or offend any person. 

    • interfering with any user using our Site. 

    • tampering with or modifying our Site, knowingly transmitting viruses or other disabling features, or damaging or interfering with our Site, including (without limitation) using trojan horses, viruses or piracy or programming routines that may damage or interfere with our Site. 

    • using our Site to send unsolicited email messages; or 

    • facilitating or assisting a third party to do any of the above acts. 

    Exclusion of competitors: You are prohibited from using our Site, including the Content, in any way that competes with our business.   

    No commercial use: Our Site is for your personal, non-commercial use only. You must not use our Site, or any of the Content, for commercial purposes, including any advertising or advertising revenue generation activity on your own website or any other platform, without obtaining a licence to do so from us. 

    Information: The Content is not comprehensive and is for general information purposes only.  It does not consider your specific needs, objectives, or circumstances, and it is not advice.  While we use reasonable attempts to ensure the accuracy and completeness of the Content, we make no representation or warranty in relation to it, to the maximum extent permitted by law.

    Discontinuance: We may, at any time and without notice to you, discontinue our Site, in whole or in part.  We may also exclude any person from using our Site, at any time and at our sole discretion. We are not responsible for any Liability you may suffer arising from or in connection with any such discontinuance or exclusion. 

    Warranties and disclaimers: To the maximum extent permitted by law, we make no representations or warranties about our Site or the Content, including (without limitation) that:

    Limitation of liability: To the maximum extent permitted by law, we are not responsible for any loss, damage or expense, howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent (Liability) suffered by you or any third party, arising from or in connection with your use of our Site and/or the Content and/or any inaccessibility of, interruption to or outage of our Site and/or any loss or corruption of data and/or the fact that the Content is incorrect, incomplete or out-of-date.  

    Indemnity: To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any Liability suffered or incurred by us arising from or in connection with your use of our Site or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after these Terms end.  It is not necessary for us to suffer or incur any Liability before enforcing a right of indemnity under these Terms.  

    Termination: These Terms are effective until terminated by us, which we may do at any time and without notice to you.  In the event of termination, all restrictions imposed on you by these Terms and limitations of liability set out in these Terms will survive. 

    Disputes: In the event of any dispute arising from, or in connection with, these Terms (Dispute), the party claiming there is a Dispute must give written notice to the other party setting out the details of the Dispute and proposing a resolution. Within 7 days after receiving the notice, the parties must, by their senior executives or senior managers (who have the authority to reach a resolution on behalf of the party), meet at least once to attempt to resolve the Dispute or agree on the method of resolving the Dispute by other means, in good faith.  All aspects of every such conference, except the fact of the occurrence of the conference, will be privileged. If the parties do not resolve the Dispute, or (if the Dispute is not resolved) agree on an alternate method to resolve the Dispute, within 21 days after receipt of the notice, the Dispute may be referred by either party (by notice in writing to the other party) to litigation. 

    Severance: If a provision of these Terms is held to be void, invalid, illegal, or unenforceable, that provision must be read down as narrowly as necessary to allow it to be valid or enforceable. If it is not possible to read down a provision (in whole or in part), that provision (or that part of that provision) is severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms. 

    Jurisdiction: Your use of our Site and these Terms are governed by the laws of NSW. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in NSW and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts. 

    Our Site may be accessed throughout Australia and overseas.  We make no representation that our Site complies with the laws (including intellectual property laws) of any country outside Australia.  If you access our Site from outside Australia, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Site.

    This online service is hosted by Squarespace. To help protect the privacy of data and personal information we collect and hold, we maintain physical, technical, and administrative safeguards. Squarespace updates and tests their security technology on an ongoing basis. All data is only accessible to Belinda Dorey Art team members. Access to your Personal Information is restricted to team members who need it to provide benefits or services to you. 

    While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.  

    To Access, Modify, Delete or Challenge the Data Collected

To protect your privacy and the privacy of others, we will need evidence of your identity before we can grant you access to information about you or change it. We undertake to respond within 30 days.
